Chairman Hans Klingzahn opens the meeting at 7:00 pm.
Roll call: Present: Hans Klingzahn, Cris Phillips, Bea Lindsay, Stephanie Renino and Reylene Van Geldern, Theresa Cuchelo arrived 7:10 pm. Absent: Hilary Roberto.
Also present: Peter Phillips, Deputy Mayor and Liaison to the Planning Board, Sarah Brown, Village Planner, Larry Paggi, Village Engineer, Victoria Polidoro, Planning Board Attorney and Don Van Nostrand, Secretary.
Acceptance of the minutes from the previous meetings held on August 15, 2013. Motion by Cris Phillips to approve and seconded by Bea Lindsay. Votes For: 5 Votes Against: 0 Motion carried.
1. Dutchess County Gymnastics - 986 Main Street - Sign Permit Application

Motion by Cris Phillips makes a motion to approve the sign for Dutchess County Gymnastics located at 986 Main Street. Motion seconded by Bea Lindsay. Votes for: 5 Votes against: 0 Motion carried.
2. Supreme Pianos of NY - 1004 Main Street - Sign Permit Application
Applicant: - Jeremy Duckles - Business Owner
Bea Lindsay makes a motion to approve the signage for Supreme Pianos of NY on Main Street Plaza. Motion seconded by Reylene Van Geldern. Votes For: 5 Votes Against: 0 Motion carried.
3. Lands of Segretti Subdivision - 36 Weston Avenue - Site Plan Application
Applicant: - Mark Day - M.A. Day Engineering, PC
Mark Day explained that when the maps were filed with the County the Board of Health asked for the details on the water and sewer connections. Due to the timeframe required we were concerned and that is why we are asking for a ninety day extension on the application.
Cris Phillips makes a motion to approve a ninety day extension on the site plan application for Lands of Segretti located at 36 Weston Avenue. Motion seconded by Bea Lindsay. Votes For: 5 Votes Against: 0 Motion carried.
4. Jackson Crossing - 71 Jackson Street - Site Plan, Certificate of Appropriateness
Applicants: - Kelly Libolt - KARC Planning Consultants
- Steve Tinkleman - Steve Tinkelman Architects
- Atty Richard Cantor - Teahan & Constantino LLP
Kelly Libolt, representing the applicants for Jackson Crossing explained that although it is a relatively simple design project it is complicated by the fact it is in two different municipalties.
This project is in the Village of Fishkill as well as the Town of Fishkill. Kelly presented the site
plan (plans on file) to the board.
Steve Tinkleman presented plans for the design of the three buildings which contains 27 units.

Richard Cantor, Attorney for Jackson Crossing, LLC explained to the board that this application would not be subject to segmentation under SEQRA Regulations. (letter to the
Village of Fishkill Planning Board on file).
Planning Board Attorney Victoria Polidor agreed that this project would not be considered segmentation under SEQRA and the legal analysis is correct.
Chairman Klingzahn stated that since the majority of this project is located in the Village of Fishkill it is appropriate the Village Planning Board seek lead agency status for this project.
Attorney Victoria Polidoro said that a resolution has been prepared with the intent that the board act as lead agency on this project. Victoria reads the resolution (copy on file).
Chaiman Klingzahn entertains a motion to adopt the resolution to become lead agency on this project. So moved, Cris Phillips. Motion seconded by Bea Lindsay. Votes For: 5 Votes against: 0 Motion carried.
Sarah Brown, Village Planner reviewed her comment letter. (letter on file)
Larry Paggi, Village Engineer reviewed his comment letter. (letter on file)
Victoria Polidor , Village Attorney raised a concern on the water supply between the Village and the Town and the agreements would have to be looked at.
The applicants said that they would notify the board when they were ready to appear again with the information requested.
