Zoning Board of Appeals Meeting                  

January 22, 2013

 

Chairperson Cathy Ann Nicholson opens the meeting at 7:00 p.m. at the Reformed Church Education Building located at 1143 Main Street, Fishkill.

Present: Cathy Ann Nicholson, Tom Newhard, Tom Brooks, John DePew and Terry Palumbo. Also present: Sarah Brown, Village Planner, Tom VanTine, Building Inspector and Don Van Nostrand, Board Secretary.

John Depew makes a motion to accept the minutes for the last meeting held on October 25, 2012. Motion seconded by Tom Newhard. All in favor: 5. Opposed: 0. Motion carried.

Cathy Ann Nicholson announces that a public hearing would be held tonight on the Alfresco Restaurante. She said that all the adjoining property owners have been notified by registered mail and that the applicant has submitted receipts for the notification. Also, the legal notice for the public hearing was published in the Poughkeepsie Journal on January 16, 2013. She also reviewed the history of this application and said that the Planning Board was lead agency and declared a negative declaration for SEQR on November 15, 2012 which allowed the application to move forward.

John Depew makes a motion to open the public hearing for Alfresco Restaurante

located at 1036 Main Street. Motion seconded by Tom Newhard. Motion for: 5 Opposed: 0 Motion carried.

Mike Gillespie updated the board on the overall site plan application which is before the planning board. He presented the sign application which requests a 5 foot variance to the 10 foot setback requirement of the Village zoning code.

After several questions were asked by the board members on sign location and distance from the building and property line Chairperson Cathy Ann Nicholson asked if there were any questions from the public. No questions or concerns were raised by the public.

Tom Newhard makes a motion to close the public hearing. Motion seconded by Theresa Palumbo. Motion for: 5 Motion: Opposed: 0 Motion carried.

Tom Newhard makes a motion to grant the 5 foot variance for Alfresco Restaurante located at 1036 Main Street. Motion seconded by John Depew.

Motion for: 5 Opposed: 0 Motion carried.

Mark Day informed the board of the following:

After receiving a variance from the Village on this project it was discovered that there were changes necessary to be made to the position of the canopy so there would be better traffic flow on the site. In the reconfiguration it lessens the variance on the front yard but now requires a variance on the side yard. It also increases the perimeter of the canopy so a variance is needed for the neon lighting.

Tom Newhard makes a motion to set a public hearing for the next meeting scheduled for February 28, 2013. Motion seconded by John Depew. Motion for:

5 Motion Opposed: 0 Motion carried.

Tom Van Tine updated the board on the reconstruction work being done in the Village Hall.

John Depew moves to adjourn the meeting. Motion seconded by Tom Brooks. All in favor. Aye. Opposed: None. Meeting adjourned.
