Zoning Board of Appeals Meeting
January 26, 2017
Chairman Tom Brooks opens the meeting at 7:00 p.m.
Present: Tom Brooks, Tom Newhard, Ann Trost, Terry Palumbo, John Depew Also present: Tom VanTine, Code Enforcement Officer, Trustees Angelo Ferrara,
Anthony Brozier and Village Clerk, Angela Arasim.
Chairman Brooks announces that there is an area variance application to review and no public hearings tonight.
1. Promenade Assisted Living - 542 Route 9 - Area Variance Application
Applicants: - Steven Laufer - Principal of Promenade
- Jennifer VanTuyl - Attorney,Cuddy & Feder LLP
Jennifer VanTuyl and Steven Laufer presented the overall site plans to convert the current Ramada Inn to a assisted living facility. There is no proposed change in the footprint of the building and there is going to be substantial additional landscaping. The Planning Board has requested that we prepare rendering
and elevations of what the building is going to look like from the front on Route 9. Jennifer VanTuyl explained that a requirement in the Village Code says that there should be at least 2000 square feet of site area per patient bed. The application is requesting an area variance to provide 1,265.44 square feet of site area per patient bed.
Jennifer VanTuyl brought up the fact that the Planning Board would like to be lead agency for SEQR on this application and has circulated to the appropriate
agencies, also the application would have to be referred to Dutchess County Planning for review and a public hearing would have to be set up.
Tom Newhard makes a motion to declare the Planning Board be lead agency on this project.
Motion seconded by John Depew. Discussion none. All in favor. Aye. Motion carried.
Attorney Jennifer VanTuyl requested that the application be referred to Dutchess County Planning for their review and comments.
Chaiman Brooks said that the referral would be sent to the County for review and comments.
Chairman Brooks entertains a motion to set a public hearing for this application at the next meeting to be held on February 23, 2017.
Tom Newhard makes a motion to set a public hearing for February 23, 2017.
Motion seconded by Ann Trost. Discussion none. All in favor. Aye. Motion carried.
