Planning Board Meeting Minutes

February 20, 2014

                                                         

Administrative:

Chairman Hans Klingzahn opens the meeting at 7:00 pm.                                        

Roll call: Present: Hans Klingzahn, Cris Phillips, Bea Lindsay, Theresa Cuchelo, Stephanie Renino, Reylene VanGeldern and Hilary Roberto.

Also present: Peter Phillips, Deputy Mayor and Liaison to the Planning Board, Sarah Brown, Village Planner, Larry Paggi, Village Engineer, Victoria Polidoro, Planning Board Attorney, Tom VanTine, Building Inspector and Don Van Nostrand, Secretary.

Acceptance of the minutes from the previous meetings held on January 16, 2014. Motion by Cris Phillips to approve and seconded by Stephanie Renino. Votes For: 5 Votes Against: 0 Motion carried.

Public Hearing:

Review:

1. Five Guys                                - 1166 Main Street           - Sign Permit Applications

    Applicant:                               - Ken Nicastro                  - Five Guys District Manager

                                                    - Grace Rusekas               - Gloede Signs

 

The applicants reviewed their request to change the building mounted sign from black to white with the back lighting remaining red.

Motion by Cris Phillips to approve new white sign with red back lighting for Five Guys. Motion seconded by Theresa Cuchelo. Votes for: 5 Votes against: 0 Motion carried.

 

2. Hawthorn Suites                     - 14 Schuyler Blvd             - Sign Permit Application

     Applicant:                               - Laila Batista                    - Hotel General Manager

                                                      - Zolie Dan                         - Chief Engineer

The applicants presented three new sign applications which were designated 2A, 2B and 2C.

After a lengthy discussion on the location of the building mounted sign (2A) it was decided that the applicants would resubmit this application at the next meeting scheduled for March 20, 2014.

Bea Lindsay makes a motion to approve sign 2B for Hawthorn Suites which is a monument sign. Motion seconded by Stephanie Renino. Votes for: 5 Votes against: 0 Motion carried.

Theresa Cuchelo makes a motion to approve the monument sign 2C for Hawthorn Suites on 14 Schuyler Blvd. Motion seconded by Cris Phillips. Votes for: 5 Votes against: 0 Motion carried.

 

3. Tao Foot Spa                            - 1158 Main Street                - Sign Permit Applications

    Applicant:                                 - Jiong Chen                          - Businss Owner

                                                      - Tom Walsh                          - Sign Language

Cris Phillips makes a motion to approve the single sided sign over the door for Tao Foot Spa. Motion seconded by Stephanie Renino. Votes for: 5 Votes against: 0 Motion carried.

Theresa Cuchelo makes a motion to approve the freestanding sign at Tao Foot Spa located at 1158 Main Street. Motion seconded by Bea Lindsay. Votes for: 5 Votes against: 0 Motion carried.

 

4. Wine & Spirit                             - 738 Route 9                          - Sign Permit Application

Owner/Applicant not present at Call Time.

 

5. Jackson Crossing                        - 71 Jackson Street                - Site Plan Application

    Applicant:                                    - Kelly Libolt                         - KARC Planning Consultants

Kelly Libolt authorized representative of Jackson Crossing, LLC presented to the board a scaled back modified version of the plan of what was originally presented to the board. The changes made to the plan now shows that the structures are now solely in the Village of Fishkill. The piece of property which is in the Town of Fishkill will be used for parking and access to Rosilia Lane. The number of units has been scaled back to 24 in the complex. The Carriage House would be used as a unit.

Chairman Klingzahn stated that the Village of Fishkill Planning Board would be lead agency for SEQR on this project.

Larry Paggi, Village Engineer made his comments on the project. (memo on file)

Sarah Brown, Village Planner made her comments on the project. (memo on file)

Victoria Polidoro, Planning Board Attorney expressed concerns on what variances would be needed, what the layout is going to be and how the density is going to be calculated as well as dealing with the flood plain issues.

The Planning Board members commented on the project and expressed concern on the street scape of the project, landscaping, historical look of the buildings and traffic impact on Jackson Street.

Sarah Brown, Village Planner demonstrated to the applicants a proposed buidling layout based on the comments of the board members.  

Chairman Klingzahn requested that the applicants revise the layout taking into consideration the comments of the board.

Kelly Libolt said that she would take into consideration the comments made by the board and present a draft at the next meeting scheduled for March 20, 2014.

 

4. Wine & Spirit*              - 738 Route 9                        - Sign Permit Application

    Applicant:                   - Ali Said                               - Business Manager

                                       - Tom Walsh                          - Sign Language

Theresa Cuchelo moves to accept the sign application for Wine & Spirit at 738 Route 9.

Motion seconded by Cris Phillips. Votes for: 5 Votes Against: 0 Motion carried.

 

Tom VanTine discussed a request from a potential business owner to place a self contained unit for use as a coffee shop in the parking lot of 992 Main Street.

 

Chairman Klingzahn covered the upcoming education training courses for Planning and Zoning Boards offered by County Planning.

 

A discussion was held on the use of Powerpoint for future presentations to the board.
