Chairman Hans Klingzahn opens the meeting at 7:00 pm.

Also present: Tom VanTine, Code Enforcement Officer and Building Inspector, Sarah Brown, Village Planner, Larry Paggi, Village Engineer, and Don Van Nostrand, Board Secretary.
Chairman Klingzahn entertains a motion to accept the minutes for the meeting held on February16, 2017. Motion made by Cris Phillips to approve. Motion seconded by, Reylene VanGeldern. Discussion none, all in favor, Aye. Motion carried.
1. Quest Diagnostics - 982 Main Street - Sign Permit Application

Code Enforcement Officer Tom VanTine explains that the building mounted sign is just
replacing the content of the existing sign that is already in place.
Chairman Klingzahn entertains a motion.
Cris Phillips moves to approve the building mounted sign for Quest diagnostics at 982 Main

Joshua Indorf presented the plans for the renovation of windows and roof for 1042 Main Street.
After reviewing the application designated 3A Chairman Klingzahn stated that there was
no significant change being made to the front of the building and that a vote was not required.

4. Toro Restaurant - 1069 Main Street - Site Plan Application

Al Fusco of Fusco Engineering representing the applicant stated he was before the board
tonight for site plan approval for change of use. There was an office building at this site
and we plan to convert it into a restaurant. Basically, there are very few changes being made
to the plans. There will be a dumpster enclosure with a wooden fence around it, restriping the
parking area with handicap accessible signs. The first floor of the building will be for the
restaurant and the second floor will be a apartment for the owner. Everything we have shown
on the plans are code compliant.

2. Eastern Pain Medicine Nagendra Upadhyayula - Business Owner

Code Enforcement Office/Building Inspector stated that the applicant is using the existing
sign which was used for several shingles will now be just one solid sign and complies to code.

1. Promenade at Fishkill - 542 Route 9 - Site Plan/Special Permit Application

Chairman Klingzahn announces that next on the agenda is the continuation of the public hearing
for Promenade at Fishkill.
Jennifer VanTuyl stated that the board had adopted a negative declaration for SEQR at the last meeting and the hearing was left open for the requested variance which was granted at the last
Zoning Board meeting held on February 23, 2017. We are back before the board tonight in hopes
that the board would consider granting site plan and special permit approval.
Chairman Klingzahn asked the public if there were any questions or comments.
Elizabeth Burgos in the audience asked whether the assisted living area would utilize the entire building or just part of the facility and what would be the time frame for completion.
Jennifer VanTuyl responded to the question and showed on the site plan that 75% of the building
would be assisted living and the remaining portion would be a hotel. As for the time frame, once
approval is given and the site plans are signed the owners would like to move forward expeditiously.
Chairman Klingzahn asked if there were any other comments from the audience and since there
were no further questions or comments made he asked for a motion to close the public hearing.

Jennifer VanTuyl reads a letter from H2M on the catch basins and piping to be used which will
satisfy the Village Engineer’s concerns in the courtyard.
Larry Paggi, Village Engineer commented on the project and had no issues at this time.
Sarah Brown stated that she had no outstanding comments and a resolution has been prepared.
No signage approval has been included in the resolution and the applicants will be required to
come back before the board for review and approval.

Cris Phillips makes a motion to approve the site plan and special use permit for Promenade at
Fishkill as amended . Motion seconded by Reylene VanGeldern. Discussion none, all in favor.

Chairman Klingzahn asked if anyone in the audience had a question or comment on this
There were comments no from the public on the project.
Sarah Brown, Village Planner had no comments on the project.
A discussion was held on the curb cut and easements on Main Street however Chairman
Klingzahn said it has no bearing on determining on whether the project go through or not.
Chairman Klingzahn also stated that he would direct the Planning Board Attorney to draft
a letter to the Village Board on her recommendations on the property easements.

Chairman Klingzahn reads the response back from Dutchess County Planning stating that
this application is a local concern and that the notice of the public hearing notice was
advertised in the Poughkeesie Journal.
