Zoning Board of Appeals Minutes
July 24, 2014
Chairman Tom Brooks opens the meeting at 7:00 p.m.
Present: Tom Brooks, Tom Newhard, John Depew, Terry Palumbo and Greg Gomes. Absent: Dan Roberto. Also present: Angelo Ferrara and Anthony Brozier, Village Board Trustees and Liaisons to the Zoning Board, Sarah Brown, Village Planner, Tom VanTine, Building Inspector and Don Van Nostrand, Board Secretary.
Chairman Brooks states that alternate board member Greg Gomes would be a voting member at tonight’s meeting.
Acceptance of the minutes from the last meeting held on April 24, 2014. John Depew makes a motion to approve the minutes for the April 24, 2014 meeting. Motion seconded by Terry Palumbo Newhard. Votes for: 4 Votes against: 0 Motion carried.
Chairman Tom Brooks announces that there are no public hearings on the agenda tonight and that there are three applications before the board for review.
Jackson Crossing LLC - 71 and 75 Jackson St - Area Variance Application
Applicant: - Kelly Libolt - KARC Planning Consultants
Richard Cantor- Attorney
Steve Tinkelman- Tinkelman Architects
Kelly Libolt presented the site plans to the board and discussed the reviews that have been held with the Village and Town Planning Boards as well as County Planning.
Chairman Brooks read a letter (on file) from Hans Klingzahn, Chairman of the Village Planning Board stating that as a result of some of the revisions requested by the Planning Board the site plan will require variances to the required front, rear and side yard setbacks.
Kelly Libolt covered each of the requested variances in the application (on file) before the board.
John Depew makes a motion to hold a public hearing on the Jackson Crossing LLC variance application on August 28, 2014. Motion seconded by Greg Gomes.
Votes for: 5 Votes against: 0 Motion carried.
Vanikiotis Retail/Office - Route 9 - Area Variance
Applicant: - Steve Tinkelman - Tinkelman Architects

Steve Tinkelman presented the site plan (on file) for the project and explained that the building would be used for retail and office space. He covered the set back variances which would be required.
Sarah Brown, Village Planner explained that after further review one of the variances requested on the application was not required and the application should be resubmitted with the correction prior to the next meeting.
John Depew makes a motion to hold a public hearing on the Vanikiotis Retail/Office Development variance application on August 28, 2014. Motion seconded by Greg Gomes Votes for: 5 Votes against: 0 Motion carried.
Ross Apartments - 12 North Street - Area Variance
Applicant: - Ciro Interante - Ciro Architect
-William Ross - Property Owner
Ciro Interante presented the plans for proposed apartments at 12 North Street by renovating an existing barn into two apartments and renovating an existing garage into one apartment. The property owner is requesting a .8% variance whereas the required maximum building coverage is 50% and the applicant can provide 50.8%. Also, the zoning code requires 80% lot coverage and the applicant can provide 80.9% thus requesting .9% variance. Since the application involves flood plain issues another variance may be required so the applicant requested that a public hearing not be scheduled at this time and would schedule another meeting with the board at a later date.
Tom Newhard makes a motion to adjourn the meeting. Motion seconded by John Depew All in favor. Aye. Opposed: None. Meeting adjourned.
