NOTICE IS HEREBY GIVEN THAT, in accordance with the provisions of the Zoning Law of the Village of Fishkill, a Public Hearing will be held by the Zoning Board of Appeals of the Village of Fishkill, Dutchess County, New York on the 25th day of September 2014 at 7:00 PM, or as soon thereafter as possible, at the Van Wyck Hall, 1095 Main Street, Fishkill, New York, for public comment on the Jackson Crossing LLC proposed variance application for property located at 71 and 75 Jackson Street, known as tax grid number 133001-6155-07-685931 and 133001-6155-07-671935, in the Village of Fishkill.

The applicant is requesting 4 area variances from the dimensional requirements in § 171-52 of the Zoning Law:
Variance No. 1 - Dwelling Units Per Acre - The applicant is requesting a variance to permit a density of 18 dwelling units per acre where 14 dwelling units are allowed, thus requesting 4 additional units per acre to allow for Multi-Family Housing. This variance request also implicates, and seeks relief from, § 171-25 of the Zoning Law.
Variance No. 2 - Front Yard Setback - The applicant is requesting a 1 foot variance to permit a front yard setback of 39 feet where 40 feet is required.
Variance No. 3 - Side Yard Setback - The applicant is requesting a 12 foot variance to permit a side yard setback of 28 feet where 40 feet is required
Variance No. 4 - Rear Yard Setback - The applicant is requesting a 7 foot variance to permit a rear yard setback of 33 feet where 40 feet is required.
The project site is located in the R-50 (Three-or-More-Family Residence District) and is comprised of two parcels totaling approximately 1.62 acres. A copy of the application is on file at the Village Hall.
All interested parties will be heard by the Zoning Board of Appeals of the Village of Fishkill at the Public Hearing to be held aforesaid.
