NOTICE IS HEREBY GIVEN THAT, in accordance with the provisions of the Zoning Ordinance of the Village of Fishkill, a Public Hearing will be held by the Zoning Board of Appeals of the Village of Fishkill, Dutchess County, New York on the 28th day of August 2014 at 7:00 PM, or as soon thereafter as possible, at the Van Wyck Hall, 1095 Main Street, Fishkill, New York for public comment on the Vanikiotis Retail and Office Development variance application located on Route 9, known as tax grid number 133001-6255-01-080714-0000.

The applicant is requesting a variance to Section 171E of the Village Code which requires a 20’-0” side yard setback. On the north side of the site the applicant is requesting 18’-0” side yard setback for the construction of the building as indicated on the site development plan. The applicant is also requesting a variance to Section 171-36B2 (Off Street Parking and Loading) which requires a maximum of 50% coverage. The applicant can provide 79.5% coverage thus requesting a 29.5% increase in the coverage area to allow for off street parking, loading and vehicular circulation. A copy of the application is on file at the Village Hall.
The application was referred to the Zoning Board of Appeals by the Village Zoning Code Enforcement Officer. All interested parties will be heard by the Zoning Board of Appeals of the Village of Fishkill at the Public Hearing to be held aforesaid.
