LEGAL NOTICE – Public Hearing – Zoning Board
NOTICE IS HEREBY GIVEN THAT, in accordance with the provisions of the Zoning Ordinance of the Village of Fishkill, a Public Hearing will be held by the Zoning Board of Appeals of the Village of Fishkill, Dutchess County, New York on the 28th day of February 2012 at 7:00 PM, or as soon thereafter as possible, at the Van Wyck Hall, 1095 Main Street, Fishkill, New York for public comment on the GJP Enterprises proposed canopy variance application located at 5 Schuyler Boulevard, known as tax grid number 133001-6255-01-080693-0000.

The applicant is requesting a variance to Section 171-53-171D Schedule of Regulations (Non-Residential) of the Village Code which requires a 50’ front yard setback. The applicant can provide 28.1’ for a proposed canopy thus requesting a 21.9’ front yard variance (Revised 1-25-13). The board previously granted a 23.1’ set back variance on April 26, 2012. Secondly, a variance is also requested to Article V 171-49C. The applicant is requesting a 55.3 square foot variance (Rev 1-25-13) for the proposed building sign and proposed neon. The board previously granted a 54.5’ variance on April 26, 2012. The site consists of one parcel and is approximately .91 acres and is located in the PI Zoning District and SD-3 signage district. A copy of the application is on file at the Village Hall.
The application was referred to the Zoning Board of Appeals by the Code Enforcement Officer. All interested parties will be heard by the Zoning Board of Appeals of the Village of Fishkill at the Public Hearing to be held aforesaid.
