Minutes of March 21, 2013 Planning Board

March 21, 2013                                            

Administrative:

Chairman Hans Klingzahn opens the meeting at 7:00 pm.                      

Roll call: Present: Hans Klingzahn, Cris Phillips, Bea Lindsay, Theresa Cuchelo and Reylene Van Geldern. Absent: Stephanie Renino. Also present: Victoria Polidoro, Planning Board Attorney, Larry Paggi, Village Engineer, Sarah Brown, Village Planner, Tom VanTine, Building Inspector and Don Van Nostrand, Secretary.

Acceptance of the minutes from the previous meetings held on February 21, 2013. Motion by Cris Phillips to approve and seconded by Bea Lindsay. Votes For: 5 Votes Against: 0 Motion carried.

Public Hearing:

1. Alfresco Restaurante - 1036 Main Street - Site Plan Application - Certificate of Appropriateness

Applicant: - Graziano Tassone - Business Owner                        

Chairman Klingzahn reads a letter from Graziano Tassone, owner of Alfresco Restaurante asking  that the continuation of the public hearing be adjourned to the next meeting to be held on April 18, 2013.  He explained that his engineer Mike Gillespie was not able to provide all the necessary items to be presented to the board tonight. Chairman Klingzahn stated that the updated plans for the project would have to be submitted to the Village by April 1st and asked Mr Tassone if he would be ready by then. Mr Tassone was present and said he would work to have the necessary plans to the Village by that submission date.

Chairman Klingzahn entertains a motion to adjourn the public hearing until the next meeting scheduled for April 18, 2013. So moved by Cris Phillips, motion seconded by Bea Lindsay Votes For: 5 Votes Against: 0. Motion carried.

Review:         

1. Lands of Segretti - 36 Weston Avenue - Sub Division Application

Applicant: - Anthony Segretti - Property Owner

                - Mark Day - M.A. Day Engineering, PC 

Mark Day representing Anthony Segretti updates the board on the history of the application and presents a new plan where the driveway has been relocated on the site and the lot line between  the two properties (owned by Mr Segretti) has been moved.

Sarah Brown, Village Planner reviewed the negative resolution that she prepared and that this is a unlisted action with regard to SEQR. This is a subdivision making one lot into two and for a single family dwelling which is consistent with the neighboring houses.

Victoria Polidoro, Planning Board Attorney reads the SEQR resolution (copy on file) to adopt the negative declaration.

Chairman Klingzahn entertains a motion to adopt the SEQR resolution. Cris Phillips makes a motion to accept the resolution. Motion seconded by Bea Lindsay. Votes for: 5 Votes against: 0 Motion carried.

Chairman Klingzahn entertains a motion to set a public hearing for April 18, 2013 for the Lands of Segretti Sub Division Application. So moved: Bea Lindsay. Motion seconded by Reylene Van Geldern.

2. GJP Enterprises, Inc  - 5 Schuyler Blvd - Amended Site Plan Application - Special Use Permit

Applicant: - Gasper Florys - Business Owner

                - Mark Day - M.A. Day Engineering, PC

Mark Day representing GJP Enterprises, Inc reviewed the history of the project and explained that the canopy has been reconfigured on the site. Also, he explained that since the moratorium on Special Use Permits has been lifted by the Village an application for a drive thru window is being submitted.

Chairman Klingzahn entertains a motion to set a public hearing for this project at the next meeting scheduled for April 18, 2013. So moved: Cris Phillips. Motion seconded by Bea Lindsay. Votes for: 5 Votes against: 0 Motion carried.

Votes For: 5 Votes Against: 0 Motion carried. Meeting Adjourned
