Mayor entertains motion to approve the minutes of the November 18th meeting, So Move Trustee Newhard, Seconded, Trustee Brozier, discussion, one typo to be corrected, All in favor, Aye, Trustee Ferrara abstained, Motion carried
Mayor discusses Intermunicipal Agreement with City of Beacon and Town of Fishkill for feasibility study and entertains motion to authorize him to sign the agreement, So Move Deputy Mayor Phillips, Seconded, Trustee Brozier, Discussion, Deputy Mayor Phillips asks if its $200,000 just for feasibility study, yes it is, All in favor, Aye. Motion carried
Mayor reads letter from water/sewer customer on Virginia Avenue requesting reimbursement for work done on sewer line, and entertains motion to reimburse customer for $1296.50 from sewer account, So Move Deputy Mayor Phillips, Seconded, Trustee Ferrara, discussion, none, All in favor, Aye. Motion carried
Mayor entertains motion to enter Executive Session to discuss pending litigation, So Move Trustee Ferrara, Seconded, Deputy Mayor Phillips, discussion, none, All in favor, Aye. Motion carried
Mayor reopens meeting. No votes taken in executive session
Mayor entertains motion to authorize Village Attorney to engage Rappaport & Meyers attorney, Victoria Polidoro, in defense of the lawsuit that we just discussed in executive session, So Move, Trustee Ferrara, Seconded, Trustee Brozier, discussion, none, All in favor, Aye. Motion carried
Mayor addresses Mr. Dave Stenger, Jackson Crossing: Mr. Stenger, there’s not a lot of happy people on this side, but based on the engineers report and your attorney’s astute crafting of a request using our law to back us into a corner, I’ll offer the following resolution.
Mayor reads resolution (attached)
Mayor: Section 57-6 does give the applicant the ability to seek a hearing, and a date to be set no sooner than 5 days prior to the meeting if you so choose.
Mayor then reads section 57-6
“The notice shall contain the following:
A description of the premises;
A statement of the particulars in which the building is unsafe or dangerous;
An order outlining the manner in which the building is to be made safe and secure or demolished and removed;
A statement that the securing or removal of such building shall commence within 30 days of the service of the notice and shall be completed within 60 days thereafter, unless, for good cause shown, such time shall be extended;
A date, time and place for a hearing before the Board of Trustees in relation to such dangerous or unsafe building, which hearing shall be scheduled not less than five business days from the date of service of the notice; and
A statement that in the event of neglect or refusal to comply with the order to secure or demolish and remove the building, the Board of Trustees is authorized to provide for its demolition and removal, to assess all expenses thereof against the land on which it is located, and to institute a special proceeding to collect the costs of demolition, including legal expenses”.

Deputy Mayor Phillips requests an email to the Board members whenever there is a water main break so they know if something is going on.
Deputy Mayor Phillips states that the old beer distribution center, there were 4 atv’s and at least 2 motorbikes riding in circles around the creek and back..(end of Blodgett)
Clerk to forward complaint to Village and Town police.
Village attorney to prepare a resolution regarding a moratorium for road opening permits
Deputy Mayor Phillips moves to adjourn,
Mayor: Before that, anybody have anything else?

Mayor: Mr. Stenger what is your plan, Tom won’t serve you until tomorrow sometime
Dave Stenger: He can serve me tonight, we have sort of made plans, we don’t wish to have a hearing
Mayor: Do you know when you’re going to do the work?
Mayor: Can we get it narrowed it down?
Richard Cantor, Jackson Crossing Attorney: As soon as Tom says go ahead
Tom Vantine: I mean you got the approval, I can have the paperwork to you in the morning by 8:00
Dave Stenger: As soon as we get the approval, I think its best for everybody
