Zoning Board of Appeals Meeting                  

April 24, 2014

Acting Chairman Tom Brooks opens the meeting at 7:00 p.m.

Present: Tom Brooks, Tom Newhard, John Depew and Terry Palumbo. Absent: Alternates: Dan Roberto and Greg Gomes. Also present: Angelo Ferrara, Village Board Trustee and Liaison to the Zoning Board, Sarah Brown, Village Planner and Don Van Nostrand, Board Secretary.

Acceptance of the minutes from the last meeting held on February 27, 2014. Motion by Terry Palumbo to approve and seconded by Tom Newhard. Votes for: 4 Votes against: 0 Motion carried.

Acting Chairman Tom Brooks announces that there is a public hearing tonight for Gulf Gas Station located at 733 Route 9. Tom Newhard makes a motion to reopen the public hearing for a continuation. John Depew seconds the motion.

Votes for: 4 Votes against: 0 Motion carried.

 

Gulf Gas Station  - 733 Route 9  -  Sign Variance Application

Applicant             - Syed Kirmani -  Property Owner

                            - Chris Vasti     -  Business Owner

No public present to comment on the project.

Tom Newhard makes a motion to close the public hearing for the Gulf Station located at 733 Route 9. Motion seconded by John Depew. Votes for: 4 Votes against: 0 Motion carried.

Sarah Brown, Village Planner prepared a table (on file) for the board to review since the applicants had revised their application since the last meeting. The applicants withdrew a number of variances initially requested. Sarah referred to the Dutchess County Referral letter (on file) and explained that a majority vote would be required on any motions.

Motion #1: To grant the variance for the Gulf Gas Station with the cloud logo sign on the building allowing an additional 23.75 square feet of building mounted signage where the Zoning law permits 50 square feet on the existing building. So moved: John Depew. Motion seconded: Terry Palumbo. Votes for: 4 Votes against: 0. Motion carried.

Motion #2: To grant a variance to allow an additional 8.5 square feet of building mounted signage where the Zoning Law permits 50 square feet on the existing canopy. So moved: Tom Newhard. Motion seconded: Terry Palumbo. Votes for: 4 Votes against: 0. Motion carried.

Motion #3: To grant a variance to allow an additional 58.5 square feet of building mounted signage where the Zoning Law permits 50 square feet on the existing canopy. So moved: John Depew. Motion seconded: Terry Palumbo. Votes for: 4. Votes against: 0. Motion carried.

Motion#4: To grant a variance to allow an additional building mounted sign on the existing canopy where the Zoning Law permits one. So moved: Terry Palumbo. Motion seconded: John Depew. Votes for: 4 Votes against: 0 Motion carried.

Motion#5: To grant a variance to allow an additional 39.42 square feet of signage where the Zoning Law permits 50 square feet on the gas pumps. So moved: John Depew. Motion Seconded: Terry Palumbo. Votes for: 4 Votes against: 0 Motion carried.

Motion#6: To grant a variance to allow six additional signs on the gas pumps where the Zoning law permits one. So moved: Terry Palumbo. Motion Seconded: John Depew. Votes for: 4 Votes against: 0 Motion carried.

Motion#7: To grant a variance to allow an additional 21 square feet of freestanding signage (it is not adding to the structure of the sign, it will be used for advertising purposes). So moved: John Depew. Motion seconded by Terry Palumbo. Votes for: 4 Votes against: 0 Motion carried.

 

Tom Newhard makes a motion to adjourn the meeting. Motion seconded by John Depew All in favor. Aye. Opposed: None. Meeting adjourned.
