WORKSHOP VILLAGE BOARD MEETING

Mayor opens Public Hearing for Bill A-2014, a proposed local law to Amend Chapter 54 of the Village Code and opens to the floor

Martin Byster, Highview Road, questions reference to below grade structures, who will review redevelopment plan, SEQRA, causative act (questions submitted in writing and on file)

Mayor responds to questions:  Demolition does include below grade portion of the structure. Structure is anything manmade.

Planning Board has jurisdiction for anything that comes before them for redevelopment

Local and County Historians would only be in involved on a case by case basis depending on the historic significance of the structure

Regarding SEQRA determination, law says SEQRA determination under this is Class I

Emergency demolition provision; when all boards are unable to meet regarding immediate determination, the Mayor may deem it unsafe

Definition of causative act would be they did something to cause the action or it can be that they did nothing that the reaction was that the building deteriorated.  We will not allow demolition by neglect

Mayor closes Public Hearing for Bill A-2014 and opens Public Hearing for Bill B-2014, a proposed local law to amend Chapter 171 to eliminate redundancies with respect to the review of historic properties proposed for demolition, and opens to the floor

Trustee Ferrara refers Mr. Byster to section of Bill B-2014 which covers most of his questions regarding emergency demolition and neglect of a property

Mayor closes Public Hearing for Bill B-2014 and opens Public Hearing for Bill C-2014, a proposed local law to amend the Village of Fishkill snow removal regulations and opens to the floor

Mayor closes Public Hearing for Bill C-2014 and opens Public Hearing for Bill D-2014, a proposed local law to amend the time period for outdoor café licenses and opens to the floor

Trustee Brozier questions if there is a provision in the code regarding removing outdoor tables in case of inclement weather

Tom Vantine: If it snows, sidewalks have to be cleared so tables have to be removed.

Brozier: Is there a violation for not complying?

Vantine: If sidewalks are not cleared

Mayor: As long as it’s covered

Mayor reads resolution to adopt Bill A-2014 as Local Law 1-2014, and entertains motion to accept as read, So Move, Deputy Mayor Phillips, Seconded, Trustee Ferrara, discussion, none, all in favor, Aye.  Motion carried.

Deputy Mayor Phillips discusses the hydrant, on Kipp and Blodget, that the snow plow piled snow so high resident could not clear out as required. He suggests making an amendment regarding unusual circumstances.

Discussion continues regarding hydrant clearing of snow during significant storms, and liability issues

Mayor reads resolution regarding copyright infringement of the Village Seal and entertains motion to accept as read, So Move, Deputy Mayor Phillips, Seconded, Trustee Ferrara, discussion, none, all in favor, Aye. Motion carried.

Mayor entertains motion to set a public hearing for the 2014-2015 proposed budget for April 21st at 7pm, So Move Trustee Brozier, Seconded, Deputy Mayor Phillips, discussion, none, all in favor, Aye.  Motion carried.

Mayor entertains motion to set a Public Hearing for Bill E-2014 a proposed local law to override the Tax Levy established in General Municipal Law §3-c, So Move Deputy Mayor Phillips, Seconded, Trustee Brozier, discussion, none, all in favor, Aye. Motion carried

Mayor entertains motion to have a special meeting on April 28th at 7pm to approve the proposed budget, So Move Deputy Mayor Phillips, Seconded, Trustee Ferrara, discussion, all in favor, Aye.  Motion carried.

Mayor reads resolution regarding June 17th Village Election and entertains motion to accept as read, So Move Trustee Brozier, Seconded, Deputy Mayor Phillips, discussion, none, all in favor, Aye. Motion carried.

Mayor entertains motion to approve Peddler application for Kona Ice, So Move Deputy Mayor Phillips, Seconded Trustee Brozier, discussion, Tom Vantine states that this is not at a fixed location, they will be driving through the Village, all in favor, Aye.  Motion carried.

Mayor entertains motion to approve sidewalk café applications submitted by Eleven-11, Penelopes Pit Stop, Locanda, and Tomato Café, So Move, Deputy Mayor Phillips, Seconded, Trustee Ferrara, discussion, none, all in favor, Aye.  Motion Carried

Trustee Ferrara updates the Board regarding Village traffic court dates which he has been researching.
