Zoning Board of Appeals Meeting
August 28, 2014
Chairman Tom Brooks opens the meeting at 7:15 p.m.
Present: Tom Brooks, Tom Newhard, John Depew, Terry Palumbo, Dan Roberto and alternates Greg Gomes and Ann Marie Trost. Also present: Angelo Ferrara and Anthony Brozier, Village Board Trustees and Liaisons to the Zoning Board, Sarah Brown, Village Planner, Victoria Polidoro, Attorney and Don Van Nostrand, Board Secretary.
Terry Palumbo makes a motion to approve the minutes for the July 24, 2014 meeting. Motion seconded by John Depew Votes for: 5 Votes against: 0 Motion carried.
Chairman Tom Brooks announces that there are two public hearings and asks for a motion to open the public hearing for the Jackson Crossing LLC project.

Jackson Crossing LLC - 71 and 75 Jackson St - Area Variance Application
Applicant: - Kelly Libolt - KARC Planning Consultants

Kelly Libolt representative for the Jackson Crossing, LLC project made a power point presentation (copy on file) to the board and public. The presentation explained in detail the various variances being requested by the applicant.
Chairman Brooks announces that the board will accept any public comments on this project. Before we begin there is a few of guidelines we would like followed.
When recognized by the chair the person addressing the board will be asked to state their name and address after signing in. The time allotted is three minutes for each speaker. Once all persons wishing to speak have spoken once any person who would like to speak again will be given an additional two minutes. Comments must pertain to the subject of the meeting and comments that have already been made should not be repeated.
At this point if anyone from the public who would like to address the board can come forward to the podium.
Tom Knips a resident of the Town of Fishkill read a statement (on file) concerning the increased density of this project in the Village of Fishkill R-50 Zone.
No other comments from the public were made.
Chairman Brooks announces that the public hearing for this project will remain open until the next meeting which will be held on September 25th. Any further concerns or comments on the project can be submitted to the Village Hall prior to that meeting and they will be considered by the board before any determination is made on this application.
Chairman Brooks entertains a motion to open the public hearing for the Vanikiotis Retail/Office Development on Route 9.
Terry Palumbo makes a motion to open the public hearing for the Vanikiotis Retail/Office Development. John Depew seconds the motion. Votes for: 5 Votes against: 0 Motion carried.
Vanikiotis Retail/Office - Route 9 - Area Variance
Applicant: - Steve Tinkelman - Tinkelman Architects

Sarah Brown, Village Planner reviewed the Dutchess County Planning and Development Referral response letter (on file). The County recommended that the Village Zoning Board deny the variance for the front yard setback variance. For voting, if the board acts contrary to the recommendation the law requires a majority vote plus one and the County would have to be notified of the reason.
Steve Tinkelman presented the site plan (on file) for the project and addressed
the remarks of the Dutchess County Planning and Development response letter.
Chairman Brooks invited the public to come forward to the podium and address the board on this proposed project.
No public comments were received.
Chairman Brooks announced that the public hearing meeting would continue on the 25th of September and entertains a motion to adjourn.
Terry Palumbo makes a motion to adjourn the meeting. Motion seconded by Tom Newhard. All in favor: Aye. Opposed: None. Meeting adjourned.
