Planning Board Meeting Minutes                                                   

Administrative:

Chairman Hans Klingzahn opens the meeting at 7:00 pm.                               

Roll call: Present: Hans Klingzahn, Cris Phillips, Theresa Cuchelo, Stephanie Renino, Reylene VanGeldern, Hilary Roberto and Matt Vetare. Also present: Pete Phillips, Deputy Mayor and Liaison to the Planning Board,  Sarah Brown, Village Planner, Victoria Polidoro, Attorney, Tom VanTine, Building Inspector and Don Van Nostrand, Board Secretary.

Chairman Klingzahn establishes that there is a quorum.

Chairman Klingzahn entertains a motion to approve the minutes for the meeting held on July 16, 2015. Motion by Cris Phillips to approve and seconded by Reylene VanGeldern.

Votes for: 5 Votes against: 0 Motion carried.

            1. Allstate                                    - 1012C Main Street              - Sign Application

Chairman Klingzahn entertains a motion for a tenant mounted sign.

Theresa Cuchelo moves to accept the sign for Allstate at 1012C Main Street for the sign as presented. Motion seconded by Cris Phillips Votes for: 5 Votes against: 0 Motion carried.

 

Chairman Klingzahn entertains a motion to approve a building mounted sign.

Theresa Cuchelo moves to accept the sign for Allstate at 1012C as per application. Motion seconded by Reylene VanGeldern. Votes for: 5 Votes against: 0 Motion carried.

 

Chairman Klingzahn entertains a motion for the directory sign. Theresa Cuchelo moves to accept the Allstate directory sign for 1012C per application. Motion seconded by Stephanie Renino. Votes for 5: Votes against: 0 Motion carried.

 

          2. Pearse/Bosquez Residence       - 25 Broad Street                   - Certificate of Appropriateness

Chairman Klingzahn entertains a motion on the application. Cris Phillips moves to approve a Certificate of Appropriateness for 25 Broad Street as given in the application. Motion seconded by Stephanie Renino. Votes for: 5 Votes against: 0 Motion carried.

 

         3. Jackson Crossing, LLC            - 71&75 Jackson Street          - Extension of Subdivision Approval

             Applicant:                                  - Kelly Libolt                          - KARC Planning Consultants

 

Kelly Libolt explained that when the Jackson Crossing subdivision was approved it was a kind of a complicated process and the first phase had to do with the subdivision of the property. In order to subdivide the land the property had to be flood proofed. The way the codes are written in the Village of Fishkill the subdivision approval expires in 180 days which is August 23rd and would like to request an extension.

Attorney Victoria Polidoro stated that the applicant is entitled to two ninety day extensions at this point and the board could vote on the first extension.

Village Planner Sarah Brown reads a prepared resolution (on file) to grant the first ninety day extension of sub division approval.

Chairman Klingzahn entertains a motion. Stephanie Renino moves to approve the resolution to grant the first ninety day extension of sub division approval for Jackson Crossing Development. Motion seconded by Cris Phillips. Votes for: 5 Votes against: 0 Motion carried.

 

Chairman Klingzahn announces that all the agenda items are covered and that he would like the board to review Village Board Bill E2015.      

Attorney Victoria Polidoro explains that under Village law an applicant has 180 days to meet the conditions of sub division approval and that applicants can get two ninety day extensions. About three years ago New York State amended its law to allow developers to have an unlimited number of ninety day extensions. The Village of Fishkill did not update its law to match the state law and this is what the proposal does.

Cris Phillips makes a motion that the Planning Board recommends that the Village Board limit the number of permitted 90 day extensions to eight. Motion seconded by Theresa Cuchelo. Votes for: 5; Votes against: 0 Motion carried.

 

Peter Phillips updated the board on the improvements being made to Village Hall, Church Street and Academy Street parking lot, sidewalk and street improvements which will be completed by September 1st in time for school opening. He also reported on the work completed on Jackson Street by Central Hudson. 

       

          Chairman Klingzahn entertains a motion to close the meeting.
