Chairman Hans Klingzahn opens the meeting at 7:00 pm.
Roll call: Present: Hans Klingzahn, Cris Phillips, Theresa Cuchelo, Matt Vetare, Reylene VanGeldern. Alternate: Caitlin Brozier. Absent: Alternate Stephen Brown. Also present: Tom VanTine, Code Enforcement Officer and Building Inspector, Sarah Brown, Village Planner, Larry Paggi, Village Engineer, Victoria Polidoro, Planning Board Attorney and Don Van Nostrand, Board Secretary.
Chairman Klingzahn entertains a motion to accept the minutes for the meeting held on January19, 2017. Motion made by Cris Phillips to approve. Motion seconded by, Reylene VanGeldern. Discussion none, all in favor, Aye. Motion carried.
Review:
1. Life Storage - 35 Merritt Blvd - Sign Permit Application
Applicant: - Dustin Miller - Cad Signs (Authorized Representative)
169 Lodi Street

Code Enforcement Officer Tom VanTine explains that the two new signs were replacing the
current signs that were already in place.
Chairman Klingzahn entertains a motion.
Cris Phillips moves to approve the pylon sign for Life Storage at 35 Merritt Blvd. Motion
seconded by Matt Vetare. Discussion none, all in favor. Aye. Motion carried.
Chairman Klingzahn entertains a motion on the second sign labeled 1B.
Theresa Cuchelo moves to approve the building mounted sign for Life Storage at 35 Merritt
Boulevard at 35 Merritt Boulevard as per application. Motion seconded by Cris Phillips.
Discussion none, all in favor. Aye. Motion carried
2. Feeling Kinda of Cozy - 1126 Main Street - Sign Permit Application
Applicant: - Toni Ann Leone - Business Owner

Business owner Toni Ann Leone presented the two sided hanging sign with a sample of the colors
and brackets for the proposed hanging sign. Also, there were no plans to light the sign.
Code Enforcement Officer Tom VanTine stated that the proposed sign complies with the Village
Code.
Chairman Klingzahn entertains a motion.
Matt Vetare makes a motion to approve the sign as proposed for Feeling Kinda of Cozy located at
1126 Main Street. Motion seconded by Theresa Cuchelo. Discussion none, all in favor. Aye.
Motion carried.
Public Hearing:
1. Promenade at Fishkill - 542 Route 9 - Site Plan/Special Permit Application
Chairman Klingzahn entertains a motion to open a public hearing for Promenade at Fishkill
located at 542 Route 9.
Cris Phillips, So moved. Motion seconded by Theresa Cuchelo. Discussion none, all in favor.
Aye. Motion carried.
Attorney, Jennifer VanTuyl of Cuddy and Feder Law Firm introduced Architect David
Mammina of H2M Architects and Engineers who presented to the board and public the plans for
the project which will be a 200 bed assisted living facility located at the Ramada Inn located on
Route 9. ( Proposed site plan drawings on file ).
Chairman Klingzahn asked the public if there were any questions or comments.
No comments or questions were received from the public in attendance and no write in comments
were received by the Village Planning Board.
Jennifer VanTuyl read the traffic study (on file) performed for the site.
Sarah Brown, Village Planner covered her comment letter (on file) to the board.
Larry Paggi, Village Engineer covered his comment letter (on file) to the board.
Victoria Polidoro, Planning Board Attorney stated there were no legal concerns.
Chairman Klingzahn entertains a motion that the Planning Board be lead agency for SEQR.
So moved, Cris Phillips. Motion seconded by Reylene VanGeldern. Discussion none, all in favor.

Sarah Brown covered Part 2 of the EAF (Negative Declaration) on file..
Chairman Klingzahn entertains a motion to declare a Negative Declaration on SEQR.
So moved, Theresa Cuchelo. Motion seconded by Matt Vetare. Discussion none, all in favor. Aye, Motion carried.
Review:
2. Dutchess Biercafe - 1097-1099 Main Street - Aryeh Siegel, Architect
Aryeh Siegel updated the board on the site plan and covered the updated drawings based
on the comments received at the last meeting and the easement problem has been resolved.
Attorney Victoria Polidoro stated that the surveyor has resolved the issue with the right a ways
and there is still a open issue on the curb cut on Main Street.
Chairman Klingzahn entertains a motion to hold a public hearing at the next meeting to be held
on March 16, 2017.
So moved, Cris Phillips. Motion seconded by Matt Vetare. Discussion none, all in favor, Aye,
Motion carried.
